Escrow & Payment Security

Escrow for Thailand Property Transactions

Most Thai property sales are paid directly, with no protection if the deal goes wrong. Escrow changes that: a licensed, independent agent holds your money until the unit is registered in your name. Here's how to use it.

Independent,
unbiased guide

In most Thai property sales, the buyer pays the seller directly — a deposit on signing, perhaps instalments, and the balance by cashier's cheque at the Land Office. If the seller disappears, the developer goes bust or the title turns out to be defective, the buyer's protection is a court case in a foreign country. Many foreign buyers never hear that there's an alternative.

There is. Since 2008, Thailand's Escrow Act has allowed a licensed, independent agent to hold the purchase money until agreed conditions are met — usually the registered transfer of the unit into your name. The money is ring-fenced from the agent's own finances. If the conditions fail, it comes back to you.

This guide explains how property escrow works in Thailand, how to use it for off-plan and resale purchases, what it costs, how it fits with the FET form, what isn't real escrow, and what to do if the seller says no. For escrow in general, see what is escrow in an international transaction.

The short answer

LicensedEscrow agents are licensed by Thailand's Ministry of Finance.
On transferThe best release condition: the unit registered in your name.
VoluntaryYou have to ask for it — ideally before paying the reservation fee.

Thai property escrow puts your purchase money with a licensed, independent agent under the Escrow Act B.E. 2551, released only when agreed conditions are met — ideally the registered transfer of title into your name, and for off-plan, certified construction milestones. It's voluntary, so negotiate it into the contract before you pay the reservation fee. A lawyer's client account or a developer's "holding account" isn't escrow. For escrow and currency together, ask our team about Vita Capital, our FX and escrow partner, whose funds are held in regulated escrow accounts until release conditions are fulfilled.

How Thai property escrow works

  1. Agree to use escrow in the sale contract — before you pay the reservation fee.
  2. Appoint a licensed agent that's independent of the seller and developer.
  3. Sign the escrow agreement, setting out the release conditions and who pays the fee.
  4. Deposit the funds with the agent, from your own account abroad.
  5. The conditions are met — milestones certified, and the unit registered at the Land Office.
  6. The agent releases the money to the seller — or returns it to you if the conditions fail.

Choosing the right release condition

The release condition is the most important line in the escrow agreement. Get it wrong and the protection is weaker than it looks.

Strong release conditions

  • The unit is registered in your name at the Land Office
  • An independent engineer certifies a construction stage
  • A clean title search is confirmed by your lawyer
  • The building's foreign quota letter is issued

Weak release conditions

  • Signing of documents
  • "Completion of construction" with no inspection
  • The developer's own confirmation
  • A fixed date, whatever has happened

For the final payment, insist that the money is released on the registered transfer of title — ownership passes on registration, so that's the moment you're actually protected.

Off-plan: controlled contracts plus escrow

Since 31 January 2025, Thailand's Consumer Protection Board has required developers to use a standard "controlled" reservation contract for off-plan condos. It gives buyers clearer, fairer terms — but it doesn't hold your money. Escrow does.

  • Use the controlled contract for the reservation, and check it's the standard form.
  • Add escrow for the staged payments, tied to certified construction milestones.
  • Insist on an independent agent — the developer's own bank can't act for its sales.
  • Agree what happens to unreleased money if the project stalls.

What is — and isn't — escrow

Several arrangements are called "escrow" in Thailand. Only one has the protection of the Escrow Act.

What escrow doesn't replace

Escrow protects the money. It doesn't check the property. You still need:

  • An independent lawyer acting only for you, not recommended by the seller.
  • A title search at the Land Office for mortgages, liens and the correct owner.
  • The foreign quota and debt letter from the building's juristic person.
  • A check on the developer — past projects, permits and the land title for off-plan.

How to ask for escrow

Because escrow is voluntary, you have to raise it — and the earlier the better. Once the reservation fee is paid, your leverage drops.

  • Raise it before you pay anything, including the reservation fee.
  • Have your own lawyer draft or review the escrow clause.
  • Name the agent and confirm its licence and independence.
  • Write the release conditions precisely, with who confirms each one.
  • Agree who pays the fee — by default it's split equally.
  • Set out what happens if the conditions fail, and how quickly money is returned.

Escrow and the FET form

For a freehold condo, the Land Office needs evidence that the purchase money came into Thailand from abroad in foreign currency — the FET form for larger transfers. Escrow adds a party in the middle, so plan the paperwork with your lawyer from the start.

  • Send from your own account abroad, in foreign currency, as you would without escrow.
  • Check whose name will appear on the FET or bank evidence when funds pass through an agent.
  • Agree the purpose wording — "purchase of condominium unit" with the project and unit.
  • Have your lawyer confirm the Land Office's position well before transfer day.

See documentation for international property payments for the FET rules in detail.

What property escrow costs

Escrow fees are set by the market, not by law — usually a fraction of one percent of the sum held, sometimes with a minimum. Illustrations on three prices, assuming the default equal split:

PriceAt 0.25%At 0.5%Your half at 0.5%
฿3,000,000฿7,500฿15,000฿7,500 (about £169)

฿8,000,000฿20,000฿40,000฿20,000 (about £451)

Illustrative percentages only — get a written quote. Under the Escrow Act the fee is split equally unless agreed otherwise, and may not be taken from the escrow account. At ฿44.38 = £1.

If the seller or developer refuses

Many sellers and developers refuse escrow, and most Thai sales still use direct payment. If yours does, you have options:

Pay as little as possible upfront

Keep the deposit small and pay the balance only at the Land Office, against registration.

Resale

Rely on the controlled contract

For off-plan, insist on the standard contract and check the developer's record carefully.

Off-plan

Choose a completed building

Buy a finished unit rather than off-plan, so you pay against something that exists.

Lower risk

Walk away

A developer that refuses any independent protection on large instalments is telling you something.

Sometimes the best option

Using escrow while you're still in the UK

Many British buyers reserve a condo on a viewing trip, fly home, and complete months later. That's exactly when escrow earns its keep — you're paying large sums for a property you can't keep an eye on.

Your lawyer can act for you under a power of attorney, attending the Land Office and confirming each release condition. The escrow agent releases money only when the documents prove the condition is met, so you don't have to be there in person. Ask for copies of every certificate and confirmation as each stage is released, and keep a running total of what's been paid out and what's still held.

Villas, houses and land

Escrow isn't only for condos. The Land Department issued guidelines in 2009 for recording land covered by an escrow agreement, so a licensed agent can protect payments on land-based deals too — for example, a villa bought through a lease or a Thai company structure. These deals are legally more complex, so independent legal advice is essential, and escrow is one of the best ways to make sure money only moves when the paperwork is right.

Questions to ask

  • Will you accept escrow with an independent, licensed agent?
  • Is the agent licensed by the Ministry of Finance, and independent of you?
  • What are the release conditions, and who certifies each milestone?
  • Is the final release tied to registration of the unit in my name?
  • What happens to unreleased money if the project stalls?
  • What's the fee, and how is it split?
  • How will the FET or bank evidence name me as the buyer?
  • How will the currency be converted, and can the rate be fixed?

Mistakes buyers make

  1. Asking for escrow after paying the reservation fee.
  2. Accepting "company escrow" run by the developer or the seller's lawyer.
  3. Using weak release conditions such as signing documents.
  4. Not checking the agent's licence and independence.
  5. Forgetting the FET rules when money passes through an agent.
  6. Leaving the currency to chance on staged payments over years.

Staying safe

  • Verify the escrow agent yourself — never rely on details supplied by the seller.
  • Confirm every set of bank details by phone before paying.
  • Use a private, protected connection when banking from show flats, hotels and cafés.
  • Keep every document — scanned and on paper — with your title deed.

Our verdict

Thai property escrow is underused and undervalued. A licensed, independent agent holding your money until the unit is registered in your name is cheap protection — especially for off-plan, where instalments are paid for years before you own anything.

Ask for it before you pay the reservation fee, reject "company escrow", write strong release conditions, and plan the FET paperwork with your lawyer. For escrow and currency together, ask our team about Vita Capital, our FX and escrow partner.

Questions people ask

Is escrow used for property in Thailand?

It's available under the Escrow Act B.E. 2551 but voluntary. Most sales use direct payment, and many foreign buyers are never offered escrow — you have to ask.

Who can act as an escrow agent in Thailand?

A commercial bank, financial institution or other company licensed by the Ministry of Finance, independent of both buyer and seller.

Can the developer's bank be the escrow agent?

Not for that developer's own sales. The Act requires the agent to have no connection to either party.

Is my lawyer's client account escrow?

No. A lawyer's client account, a developer subsidiary or an intermediary holding funds isn't escrow under the Act.

When should the money be released?

For the final payment, on the registered transfer of the unit into your name. For off-plan instalments, on independently certified construction milestones.

How much does property escrow cost?

Usually a fraction of one percent of the sum held, sometimes with a minimum. By default the fee is split equally between buyer and seller.

When should I ask for escrow?

Before you pay anything, including the reservation fee. Your leverage drops once money has changed hands.

What are controlled off-plan contracts?

Since 31 January 2025, developers must use a standard reservation contract approved by the Consumer Protection Board. It improves terms but doesn't hold your money — escrow does.

Does escrow affect the FET form?

It can. Plan with your lawyer so the foreign-currency evidence still shows the money came from you, from abroad, for the purchase.

What if the developer refuses escrow?

Keep upfront payments small, rely on the controlled contract, consider a completed building — or walk away.

Does Vita Capital offer property escrow?

Yes. Vita Capital offers real estate escrow, with funds held in regulated escrow accounts until release conditions are fulfilled, alongside currency exchange.

How do I ask about Vita Capital escrow?

Use the enquiry form on this page. We introduce you to Vita Capital, who will explain how escrow could work for your purchase.
